What is Tier II Reporting?

Submission of Tier II form is required under Section 312 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA). The purpose of this form is to provide state, tribal, and local officials, and the public with specific information on potential hazards.

What is EPCRA?

The Emergency Planning and Community Right-to-Know Act (EPCRA) was established in 1986 to address a major industrial accident. It is implemented in all 50 states.

EPCRA mandates the creation of an emergency planning network. Each state must have a State Emergency Response Commission (SERC), which sets up planning districts and oversees Local Emergency Planning Committees (LEPCs). LEPCs develop and maintain community emergency response plans and serve as the primary interface with the public for chemical emergency preparedness.

A fundamental principle of EPCRA is the need for continuous coordination and information sharing among industry, emergency planners, responders, and the public. However, funding options for this purpose are often limited. Therefore, finding ways to streamline processes and enhance efficiency is crucial due to resource constraints.

Who must file Tier II reports?

Facilities with over 10,000 lbs of non-EHS hazardous chemicals or EHS RQ thresholds must report annual Tier II. Hazardous chemicals are defined by OSHA as those that can cause physical or health hazards. Common on-site chemicals like antifreeze, ethanol, and diesel are subject. Underground tank thresholds are 75,000 gallons for gasoline and 100,000 for diesel.
